Terms of Service

This English translation is provided for reference only. The Japanese version is the official text, and if the two differ, the Japanese version prevails.

These Terms of Service (the "Terms") set out the conditions for using the smartphone app "WYBB - 筋トレ・体重記録" and its related services (together, the "Service") provided by Masataka Kamochi (the "Operator"). Anyone who uses the Service (a "User") must agree to these Terms and the Privacy Policy before using the Service.

Article 1 (Scope)

  1. These Terms apply to all matters relating to the use of the Service between Users and the Operator.
  2. Individual notices that the Operator posts in the Service (such as prices and usage limits) form part of these Terms.

Article 2 (Eligibility)

  1. The Service is only available to people aged 18 or older. This is because the terms of the external generative AI services used by the Service do not permit their use in services used by people under 18.
  2. Users create an account with "Sign in with Apple" provided by Apple.

Article 3 (What the Service Provides)

  1. The Service lets you record your body weight, body composition and training, and shows summaries of those records (free of charge).
  2. Users of the paid plan can also use the following features, which rely on generative AI:
    • Weekly coaching (text) based on a summary of your records
    • Reference images of a physique based on your body composition figures
    • Reward cards (images) when you reach your weekly training goal
  3. Users of the free plan can also receive their first reward card only.

Article 4 (Output from Generative AI)

  1. The information provided by the Service is general fitness information for reference. It does not replace medical treatment, consultation, or medical diagnosis or advice. If you have a medical condition or any concern about your health, consult a doctor or other professional.
  2. Output from generative AI may contain errors or inaccuracies. The Operator does not guarantee that the output is accurate, complete or useful.
  3. Physique images and reward cards are reference images of a fictional person drawn by generative AI from the figures you entered. They are not photos of you, and they do not promise any future physique or result.
  4. Users may use the generated text and images for personal purposes.

Article 5 (Paid Plan)

  1. The paid plan costs ¥980 per month (including tax).
  2. Payment is made through Apple's App Store and renews automatically. To stop renewal, turn off auto-renewal in the App Store settings at least 24 hours before the end of the current period.
  3. If you cancel, you can still use the paid features until the end of the period you have paid for. After that, you can continue to use the Service on the free plan.
  4. Refunds of fees already paid are decided by Apple under the App Store's rules. The Operator does not give prorated refunds.

Article 6 (Usage Limits of the Paid Plan)

  1. The paid features have the following monthly limits:
    • Physique images: up to 10 per month
    • Weekly coaching: up to 5 per month
    • Reward cards: no limit (one each time you reach your weekly goal)
  2. The limits reset on the 1st of each month (Japan time). Unused uses do not carry over to the next month.
  3. Failed generations are not counted.
  4. The Operator may change the limits, for example because of changes in the cost of generative AI, after announcing the change in the Service in advance.

Article 7 (Prohibited Conduct)

Users must not:

  1. Act in violation of laws or public order and morals
  2. Place an excessive load on the Service's servers or network, or access them without authorization
  3. Misuse the Service's mechanisms to get around the usage limits
  4. Impersonate another person, or let a third party use their account
  5. Use content generated through the Service to harm another person's reputation or rights
  6. Do anything else that the Operator reasonably considers inappropriate

Article 8 (Deleting Your Account)

  1. Users can request deletion of their account from the settings in the app.
  2. Your data is kept for one month after the request. During that month you can download the images you generated and cancel the deletion. After one month, your account and all records, images and coaching history are deleted and cannot be restored.
  3. Deleting your account does not automatically stop your App Store subscription. Before deleting your account, turn off auto-renewal in the App Store settings.

Article 9 (Changes to or Suspension of the Service)

  1. The Operator may suspend all or part of the Service temporarily when unavoidable, such as for maintenance, outages or the suspension of external services.
  2. The Operator may change the content of the Service or end it after announcing this in the Service a reasonable time in advance.

Article 10 (Disclaimer and Limitation of Liability)

  1. The Operator does not guarantee that the Service is free of defects in fact or in law.
  2. The Operator is not liable for damage caused to Users by the use of the Service, except where the Operator acted intentionally or with gross negligence.
  3. Even where the Operator is liable despite the preceding paragraph, except in cases of the Operator's intent or gross negligence, liability is limited to direct and ordinary damage, up to the amount of the fee the User paid for the Service in the month the damage occurred.

Article 11 (Personal Information)

User information is handled in accordance with the separate Privacy Policy. To provide the generative AI features, part of the records you enter is sent to external generative AI services (details are in the Privacy Policy).

Article 12 (Changes to These Terms)

  1. The Operator may change these Terms under the provisions of the Civil Code of Japan on changes to standard terms.
  2. When the Terms change, the Operator announces the content of the change and the date it takes effect in the Service before that date.

Article 13 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan. Any dispute relating to the Service is subject to the exclusive jurisdiction, in the first instance, of the district court or summary court having jurisdiction over the Operator's address.
